Protecting brand voice and avoiding pitfalls

Keep AI on-brand and out of legal trouble — the guardrails every marketer needs.

AI can produce a lot of marketing fast — which means it can produce a lot of off-brand or risky marketing fast. Guardrails are what let you scale AI safely. Two big risks: losing your voice, and shipping something false or non-compliant.

Protecting brand voice. Generic AI copy is instantly recognizable and erodes a distinctive brand. Defend it:

  • Codify your voice in writing — a voice guide, a "words we do/don't use" list, and a prohibited-claims list — and feed it to your tools (and use brand-voice features in tools like Jasper/Writer).
  • Give AI your canonical sources: pricing from the pricing page, features from the spec sheet, positioning from the brand doc. Don't let it improvise facts about you.
  • Keep human editorial control. AI drafts; a person ensures it sounds like the brand. The bigger your content volume, the more this matters — scaled generic content is a brand liability, not an asset.

Avoiding the hallucination trap. AI invents confident falsehoods — wrong prices, fake features, made-up stats, fabricated quotes. In marketing that's both a trust problem and a legal one (a false comparative claim or invented statistic can be actionable). Mandate a fact-verification checkpoint before anything ships, especially for numbers, competitive/comparative claims, and anything about your own product. Also monitor what AI engines say about your brand and correct your source material where they get it wrong — "brand hallucination management" is a new marketing discipline.

Legal and disclosure basics (US — verify specifics with counsel):

  • The FTC's rule against fake and AI-generated reviews and testimonials is in force — no fake or AI-generated reviews, no fake endorsements, and material connections must be disclosed.
  • Don't overstate your own AI ("AI-washing") — the FTC has pursued deceptive AI claims.
  • Disclose where non-disclosure would deceive (synthetic endorsements, "real person" claims), and follow platform rules requiring labels on AI-generated/altered media.
  • Human review before publish is the durable safeguard, especially for comparative, health, finance, or persona-based content.

The pattern: scale AI's production, but never its judgment or its accountability. Codify your voice, feed AI your real facts, verify everything before it ships, and follow the disclosure rules. Do that and you get AI's speed and keep the trust and legal safety that a brand runs on. Skip it and you scale mistakes — off-brand copy, false claims, compliance violations — just as fast.
